Connecticut Enacts New Lighter Regulation

The state of Connecticut became the first state to approve a regulation mandating compliance to the ASTM industry standards for lighters.  Under this new regulation it specifies that no person shall offer or sell any counterfeit lighter or unsafe lighter within the state. It further clarifies that this includes free samples given out to a person in the state. 

Per the regulation, “counterfeit lighter” is defined as “any lighter that infringes on the intellectual property rights of (A) any citizen of the United States, or (B) any entity that is protected by any federal or state intellectual property law”. And per the regulation, an “unsafe lighter” means a disposable or refillable cigarette lighter that does not comply with the current version of ASTM F400 or a utility lighter that does not comply with the current version of ASTM F2201.  

This regulation was approved May 10, 2022, and becomes effective October 1, 2022.  Therefore, beginning October 1st, all new lighters offered within the state of Connecticut need to be compliant with both the safety and labeling aspects of these ASTM standards, as applicable.
