CPSC Publishes Notice of Proposed Rulemaking within Federal Register for Bassinets and Cradles

On April 16, 2024, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register a Notice of Proposed Rulemakings for revisions to the Safety Standard for Bassinets and Cradles (16 CFR 1218).

Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. The Commission is proposing revisions to the current safety standard for Bassinets and Cradles as a part of a periodic review as instructed under CPSIA, section 104(b)(2).

The current 16 CFR 1218 Final Rule references ASTM F2194-13 with modifications. The F2194 standard underwent several revisions since the 2013 version. However, the revised versions were not incorporated by reference as a mandatory standard for the 1218 Final Rule.

The 2024 Notice of Proposed Rulemaking for 16 CFR 1218 proposes to adopt the ASTM F2194-22e1, Safety Standard for Bassinets and Cradles as the new referenced mandatory standard with thirty modifications. The modifications include revisions to the scope and definitions, revisions to current performance requirements, additions of new performance requirements, test method revisions and revised warning requirements.

Major changes within the NPR include performance requirements for Product and Bassinet/Mattress Support Height, Sidewall Rigidity, Sleep Surface Deflection/Firmness, Maximum Sleep Surface Head-to-Toe Angle, Maximum Side-to-Side Tilt Angle for Non-Rocking Bassinets, Electrically Powered Bassinets/Cradles, and After-Market Mattress requirements.

Once a revised Final Rule is approved and published in the Federal Register, the tentative effective date will be 180 days from the date of publication within the Federal Register.

Public comments on the Bassinet and Cradle NPR may be submitted up to June 17, 2024.
