Proposed US PFAS Activity Update

The U.S. Federal government has proposed a bill related to PFAS.  It was initially proposed in mid-April and was referred to committee with no further movement to date.  

Below summarizes movement on some state bills and proposal of a new bill at the federal level.

H.R. 8074 (S4187), ‘the Forever Chemical Regulation and Accountability Act of 2024’ 

Status: Introduced on April 18, 2024, referred to committee with no movement as of this bulletin’s publication. 

Dates: To be effective as of enactment date with requirement dates throughout the next ten years. 

Summary
The 107-page bill includes:
• Agreement of National Academies of Sciences, Engineering, and Medicine (NASEM) to study risks of PFAS and classification of essential or non-essential uses.
• Requirements for Phase out of Manufacture and Use of PFAS and PFAS products:
      o Phasing out non-essential PFAS production, consumption, and possession, as well as prohibiting release of any PFAS into the environment from manufacturers and commercial users within ten years.
     o Prohibiting specific PFAS-containing products with effective dates over the next ten years including many products already covered by state level PFAS laws.
• Requiring all PFAS manufacturers and users to report certain information to the EPA under the Toxic Substances Control Act (TSCA).
• Requiring manufacturers and users to submit a PFAS product phaseout plan for phaseout completion within ten years.
• Encouraging, to the maximum extent possible, use of alternatives that reduce risk to human health and the environment.
• Prioritizing creation of rapid response hubs to advance PFAS replacement and remediation.
• Other provisions related to fees, civil suits, enforcement, Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), etc.
