Australia Issues Updates to Mandatory Safety Standard of Toys Containing Magnets

Australian Competition and Consumer Commission (ACCC) has issued an update to the mandatory safety standard of toys containing magnets - Consumer Goods (Toys Containing Magnets) Safety Standard 2020. There is a transition period of 12 months beginning on the day of commencement of the updated standard (August 28, 2020).   

According to the updated standard:  

“Magnetic toy” means a product or material supplied new that:
· is designed or clearly intended for use in play by a child under 14 years of age; and
· is supplied with one or more magnets or magnetic components.  

A magnetic toy must comply with one of the following requirements:
- AS/NZS 8124.1:2019 Safety of toys part 1: Safety aspects related to mechanical and physical properties
o clause 4.1 “Normal use” (with modification)
o clause 4.31 “Magnets and magnetic components” (with modification)  

- EN 71-1:2014+A1:2018 Safety of toys  part 1: Mechanical and physical properties
o clause 4.23 “Magnets”  

- ISO 8124.1:2018 Safety of toys part 1: Safety aspects related to mechanical and physical properties
o clause 4.1 “Normal use” (with modification)
o clause 4.31 “Magnets and magnetic components” (with modification) 

- ASTM F963-17 Standard Consumer Safety Specification for Toy Safety
o clause 4.38 “Magnets”
o clause 8.5 “Normal use testing” (with modification)
o clause 8.9 “Tension test for removal of components” (with modification) 

There is a transition period of 12 months beginning on the day of commencement of the updated standard (August 28, 2020). During the transitional period, a magnetic toy must comply with either: 
- the updated standard “Consumer Goods (Toys Containing Magnets) Safety Standard 2020” or
- the previous standard “Consumer Protection Notice No. 5 of 2010 (Consumer Product Safety Standard for Toys Containing Magnets)”. 

After the transitional period, a magnetic toy must comply with the updated standard.
