Enforcement Trends

  • Product categories with the most settlements/judgments: 
    • Food and dietary supplements: 34%
    • Kitchen Accessories & Crockery: 14%
  • Metals were the chemicals named in the most settlements and judgements and accounted for 61% of settlements/judgements.  158 settlements/judgments were for lead, 21 for two or more metals, 16 for cadmium, 2 for mercury and 2 for arsenic.
  • Phthalates accounted for 17% of settlements/judgements, with 40 settlements/judgements for DEHP, 7 for DBP, 5 for DINP and 4 for two or more phthalates. 
  • PFAS Note: There were 6 settlements/judgements for PFOA.  They were for dietary supplements, pet beds, umbrellas, jackets, pillows and paper straws.
