On October 8, 2023, California expanded upon their existing cosmetic ingredient ban, prohibiting 25 new ingredients as well as 16 boron substances in cosmetic products effective January 1, 2027.
AB-496: Cosmetic Safety prohibits a person or entity from manufacturing, selling, delivering, holding, or offering for sale in commerce any cosmetic product that contains the specified 41 intentionally added ingredients listed below.
As well as the following boron substances:
- Boric acid
- Perboric acid: Sodium salt; Sodium salt, monohydrate; Sodium perborate monohydrate
- Borates, tetraborates, octaborates, and boric acid salts and esters, including all of the following:
- Disodium octaborate anhydrous
- Disodium octaborate tetrahydrate
- 2-Aminoethanol, monoester with boric acid
- 2-Hydroxypropyl ammonium dihydrogen orthoborate
- Potassium borate, boric acid potassium salt
- Trioctyldodecyl borate
- Zinc borate
- Sodium borate, disodium tetraborate anhydrous; boric acid, sodium salt
- Tetraboron disodium heptaoxide, hydrate
- Orthoboric acid, sodium salt
- Disodium tetraborate decahydrate; borax decahydrate
- Disodium tetraborate pentahydrate; borax pentahydrate
Background: In 2020, California passed a law prohibiting 11 substances and 13 per- and polyfluoroalkyl substances (PFAS) and their salts effective January 1, 2025
