California Proposition 65 Settlements

The following is a summary of California Proposition 65 settlements recently finalized that involve consumer products in Q1, 2026.

Requirements for New Settlements:

Pants
• Less than 50 ppm (0.005%) of total fluorine, if exceed, further testing conduct for PFOA (#1)

Shower curtains
• Less than 50 ppm (0.005%) of total fluorine, if exceed, further testing conduct for PFOA (#1)

Update current criteria for other existing test lines:

Cooling hat, fabric tablecloths, pillows, generator covers, ironing board pads, changing pads, jackets and ponchos meant to protect the wearer from rain and snow and rain pants, first aid, athletic, body tapes, bandages, and wraps, soft carrying bags, cases, totes backpack coolers and diaper backpacks, children's lunch bags, coverall bibs and other bibs, gas tank cover, seat pads and umbrella

• Less than 50 ppm (0.005%) of total fluorine, if exceed, further testing conduct for PFOA (#1)
Changes: According to California Health and Safety Code Div.104 Ch.13.5 [108970 - 108971] (AB1817), starting January 1, 2027, the content of PFAS (parts per million) in products or components will be limited if it reaches or exceeds 50 ppm. Meanwhile, AFIRM RSL – industry practice already lowered the limit to 50 ppm in its 2026 update. Therefore, BV default to lowering the limit to 50 ppm.

Baby wipes and flushable wipes
• Less than 50 ppm (0.005%) of total fluorine, if exceed, further testing conduct for PFOS (#2)
Changes: Added new settlement citation for flushable wipes

Remarks
#1 PFOA (BV reporting limit is 0.01 ppm)
#2 PFOS (BV reporting limit is 0.01 ppm)
