California Proposition 65 Settlements

The following is a summary of California Proposition 65 settlements recently finalized that involve consumer products in Q2, 2026.

Requirements for New Settlements:

Paper/plant-based food packaging 

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOS (#2)

Iced tea

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOA (#1)
• No more than 0.5 micrograms of lead per day 
• No more than 0.3 micrograms of mercury per day 
• Or utilize a warning statement

Dietary supplement products

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOA (#1)
• Or utilize a warning statement

Update current criteria by additional settlements:

Pillows and cushions

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOA (#1)
  Changes: Added new settlements citation for cushions

Pants and skirts

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOA (#1)
  Changes: Added new settlements citation for skirts

Personal care wipes

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOS (#2)
  Changes: Expanded the scope of personal care wipes, including but not limited to baby, cosmetic, facial, hand, flushable, and pet wipes. It does not include cleaning wipes

Vegetable chips

• No more than 0.5 micrograms of lead per day 
• No more than 4.1 micrograms of cadmium per day  
  Changes: change the scope to vegetable chips, including but not limit to beet chips and potato chips

Dietary supplement products

• No more than 0.3 micrograms of mercury per day
  Changes: Added a new settlement for mercury

Cooling or water-resistant hat

• Less than 50 ppm (0.005%) of total fluorine; if it exceeds, further testing is conducted for PFOA (#1)
  Changes: Expanded to scope including water resistant hats
