California Proposition 65 Settlements - June 2023

The following is a summary of California Proposition 65 settlements recently finalized that involve consumer products and food.  

REQUIREMENTS FOR NEW SETTLEMENTS

Mushrooms
• a. No more than 0.5 µg lead per day, and 
  b. No more than 4.1 µg cadmium per day
• Or utilize a warning statement 

Dental kits with PVC case  
• No more than 1000 ppm (0.1%) DEHP
• Or utilize a warning statement 

Handbags
• No more than 1000 ppm (0.1%) for each phthalate (DEHP, DBP, BBP and DINP)
• Warning label cannot be used as an alternative to meet the requirement 

Backpacks
• No more than 1000 ppm (0.1%) for each phthalate (DEHP, DBP, BBP, DINP and DIDP)
• Warning label cannot be used as an alternative to meet the requirement 

Messenger bags and carriers
• No more than 1000 ppm (0.1%) for each phthalate (DEHP, DBP and DINP)
• a. No more than 100 ppm (0.01%) total lead, and 
  b. No more than 1 µg lead result in Ghost WipeTM test
• Warning label cannot be used as an alternative to meet the requirement 

Watches with watch bands
• No more than 90 ppm (0.009%) total lead in paints and surface coatings
• No more than 100 ppm (0.01%) total lead in substrates
• Warning label cannot be used as an alternative to meet the requirement 

UPDATE CURRENT TESTING REQUIREMENT BY ADDITIONAL SETTLEMENTS

Belts
• No more than 90 ppm (0.009%) lead in paints and surface coating/ PVC / leather component
• a. No more than 100 ppm (0.01%) total lead in other components, and 
  b. No more than 1 µg lead result in Ghost WipeTM test
• Or utilize a warning statement
Changes: Limit lowered for PVC/ leather/ other component. 

Footwear
• No more than 90 ppm (0.009%) total lead in paints and surface coatings
• No more than 200 ppm (0.02%) total lead in PVC component
• No more than 300 ppm (0.03%) total lead in other component
• Or utilize a warning statement
Changes: Removed leather component limit. 

Shelf liners
• No more than 1000 ppm (0.1%) for each phthalate (DEHP, DBP, BBP, DINP, DIDP, and DnHP)
• No more than 200 ppm (0.02%) total lead 
• Or utilize a warning statement
Changes: Additional phthalates (DBP, BBP, DIDP & DnHP) and lead requirement were added.

Hats (including Witch hats- Halloween costumes)
• No more than 1000 ppm (0.1%) for each phthalate (DEHP, DBP, BBP and DINP)
• Or utilize a warning statement
Changes: Covered all type of hats but not only witch hats 

Hair products / Liquid soaps & powder soaps/ skin creams/ Nail protection products/ Cleaners
• Shall not contain Cocamide Diethanolamine
• Warning label cannot be used as an alternative to meet the requirement
Changes: Covered more products scope including hair product/ powder soaps/ skin creams/ Nail protection products/ Cleaners
