California Signs PFAS in Cosmetics Bill 2771 into Law

California’s Governor approved Assembly Bill No. 2771, which adds Section 108981 to the Health and Safety Code.  The bill prohibits, beginning January 1, 2025, the manufacture and sale any cosmetic product that contains intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS). 

Definitions in the Act:
• “Cosmetic product”: an article for retail sale or professional use intended to be rubbed, poured, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body for cleansing, beautifying, promoting attractiveness, or altering the appearance. 
• “Perfluoroalkyl and polyfluoroalkyl substances” or “PFAS”: a class of fluorinated organic chemicals containing at least one fully fluorinated carbon atom. 
• “Intentionally added PFAS”: either of the following: 
o PFAS chemicals that a manufacturer has intentionally added to a product and that have a functional or technical effect on the product.  
o PFAS chemicals that are intentional breakdown products of an added chemical. 

Summary:
In 2020, California banned the use of 13 specified PFAS substances in cosmetic products via the Toxic-Free Cosmetics Act.  

California is now adding Section 108981.5 to the Health and Safety Code, which broadens the ban of PFAS chemicals in cosmetics as follows: 
Beginning January 1, 2025, no one can manufacture, sell, deliver, hold, or offer for sale in commerce any cosmetic product that contains intentionally added perfluoroalkyl and polyfluoroalkyl substances (PFAS).
