CPSC Publishes Direct Final Rule for Children’s Folding Chairs and Children’s Folding Stools

On Monday May 17, 2021, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register a Direct Final Rule for 16 CFR Part 1232, Safety Standard for Children’s Folding Chairs and Children’s Folding Stools. 16 CFR Part 1232 will now reference ASTM F2613-21, Standard Consumer Safety Specification for Children’s Chairs and Stools as mandatory with no modifications. 

The previous version of the 16 CFR 1232 referenced the ASTM F2613-19 with no modifications. The ASTM F2613-21 was revised to include (1) an exemption for infant and infant/toddler rockers that already fall under the scope of ASTM F3084, (2) a clarification that children’s ottomans may be included in the scope of the standard, (3) plus other minor editorial changes. 

16 CFR 1232 only applies towards children’s folding chairs and children’s folding stools. The ASTM standard applies to both folding and non-folding children’s chairs and stools. 

This Direct Final Rule will become effective August 21, 2021 unless the CPSC receives any significant or adverse comments by June 16, 2021.
