EU POP: Restriction of PFHxS

On August 8th, 2023, the European Union published Regulation (EU) 2023/1608 to amend Annex I of the EU POP Regulation by Perfluorohexane sulfonic acid (PFHxS), its salts and related compounds.

The regulation enters into force 20 days after publication in the Official Journal of the European Union, means, August 28th, 2023.

Background

By publishing Regulation (EU) 2023/1608, EU introduce further restriction of perfluorinated substances. This Regulation restricts Perfluorohexane sulfonic acid (PFHxS), its salts and PFHxS-related compounds under EU POP Regulation ((EU) 2019/1021). PFHxS is already listed as Substance of Very High Concern (SVHC) under REACH. Apart of other applications, it might be used as water / stain repellent on carpets, leather, apparel, textiles, upholstery, and paper products. It might be used as well in fire-fighting foams, paints, non-stick ware and electronic products. The restriction will apply from 28 August 2023.

Restrictions are as follows:

Substances	restriction
Perfluorohexane sulfonic acid (PFHxS), its salts	≤ 0.025 mg/kg in substances, mixtures or articles
PFHxS-related compounds	≤ 1 mg/kg (as sum) in substances, mixtures or articles
PFHxS, its salts and PFHxS-related compounds	≤ 0.1 mg/kg (as sum) in firefighting foam mixtures

Perfluorohexane sulfonic acid (PFHxS), its salts and PFHxS-related compounds means the following:
(i) perfluorohexane sulfonic acid, including any of its branched isomers;
(ii) its salts;
(iii) PFHxS-related compounds which, for the purposes of the Convention, are any substance that contains the chemical moiety C6F13S- as one of its structural elements and that degrades to PFHxS.
