EU Publishes Packaging and Packaging Waste Regulation 2025/40

EU has published EU 2025/40 on packaging and packaging waste, this regulation will replace Directive 94/62/EC on packaging and packaging waste.

Requirement Summary and Effective Dates:

On January 22, 2025, the Regulation (EU) 2025/40 on Packaging and Packaging Waste was published in the Official Journal of the European Union. The regulation establishes requirements regarding the entire life cycle of packaging and packaging waste, including waste reduction measures, harmful/hazardous substances restrictions, and promotion of recyclability and reuse.

Restricted Substance    Limit

Sum of the concentrations of lead, cadmium, mercury and hexavalent chromium

≤ 100 mg/kg

The regulation introduces new restrictions on the use of PFAS in food contact packaging materials from August 12, 2026.

Restricted SubstanceLimit

Any PFAS as measured with targeted PFAS analysis (polymeric PFAS excluded from quantification)    

≤ 25 ppb

Sum of PFAS measured as the sum of targeted PFAS analysis, where applicable with prior degradation of precursors (polymeric PFAS excluded from quantification)    

≤ 250 ppb

PFASs (including polymeric PFAS)1

≤ 50 ppm

1If total fluorine exceeds 50 mg/kg the manufacturer, importer or downstream user shall, upon request, provide to the manufacturer or the importer proof of the quantity of fluorine measured as content of either PFAS or non-PFAS.
