Japan Restricts PFHxS and Its Salts on Certain Products

On December 1, 2023, the Japan Ministry of Economy, Trade and Industry (METI) published a Cabinet Order no.343 to regulate Perfluorohexane sulfonic acid (PFHxS) and its salts as Class 1 specified chemical substance under “Act on the Evaluation of Chemical Substances and Regulation of their Manufacture, etc.” under the Chemical Substances Control Law (CSCL). This Cabinet Order will be effective on February 1, 2024.

Summary of the Cabinet Order

PFHxS and its salts is designated as Class I Specified Chemical Substances.
The following ten categories of designated products are prohibited to be imported if they contain PFHxS and its salts:

Treated fabrics with water or oil repellent properties
Etching agents used in metal machining
Etching agents used in manufacture of semiconductors
Surface treatment agents for plating and their prepared additives
Anti-reflective agents used in manufacture of semiconductors
Resists for semiconductors
Water and oil repellents and fiber protection agents
Fire extinguishers, fire extinguishing agents for use in fire extinguishers and fire extinguishing foams
Treated clothing with water or oil repellent properties
Treated floor coverings with water or oil repellent properties

Two effective dates:

February 1, 2024: Come into force of PFHxS and its salt as Class I Specified Chemical Substances.
June 1, 2024: Prohibit the import of PFHxS and its salt in ten categories of products.
