Minnesota is proposing Bill SF 1380 and companion Bill HF 1486 prohibiting certain chemicals in packaging. The proposed coding for the new law is in Minnesota Statutes, chapter 116, section 116.941, Toxic Chemicals in Packaging; Prohibition. This law becomes effective the day following final enactment.
Highlights
As of January 1, 2028, a person shall not distribute, sell, or offer for sale in the state of Minnesota any packaging that contains any of the following chemicals:
- polyvinyl chloride
- polyvinylidene chloride
- polystyrene, including expanded polystyrene
- polycarbonate
- polyethylene terephthalate glycol
- polyethylene terephthalate that is opaque or pigmented
- antimony trioxide
- melamine
- ortho-phthalates
- bisphenols
- halogenated flame retardants
- nondetectable pigments, including carbon black
- oxo-degradable and oxo-biodegradable additives
- UV 328 [2-(2H-benzotriazol-2-yl)-4,6-di-tert-pentylphenol]
- short- and medium-chain chlorinated paraffins
- benzophenone or its derivatives
- formaldehyde
- perchlorate
"Packaging" is defined as a container and any material that provide a means of transporting, marketing, protecting, or handling a product. It includes pallets and packing such as blocking, bracing, cushioning, weatherproofing, strapping, coatings, closures, inks, dyes, pigments, and labels.
"Manufacturer" is defined as a person that manufactures a product or whose brand name is affixed to the product. It also includes the importer of record for the product imported into the US for use in a commercial enterprise that sells or distributes the product in Minnesota.
