New Jersey Amends PFAS Law, Adds Apparel

New Jersey’s SB 1281 (P.L. 2026, c.76) amends their existing PFAS in Products law, P.L. 2025, c.202, to add apparel and clarify the definition of diaper products.  In addition, the amendment adds a certification and notification requirement to certify the products do not contain intentionally added PFAS.

Amendments to New Jersey’s law are as follows:

  • Diaper products are now listed as a separate category in the scope of the ban on intentionally added PFAS and defined as “an absorbent product, either disposable or reusable, manufactured to be worn to contain human waste.”  
    • This does not include menstrual products covered in a separate law.
  • Apparel is added to the scope of the ban. Footwear and outerwear for extreme wet conditions are included in the definition of apparel.
    • Exclusions: Personal protective equipment, clothing exclusively for the military, and protective equipment for safe use of motorcycles and off-road vehicles
  • Apparel and diaper products manufacturers are required to certify products and submit notification to the Division of Consumer Affairs in the Department of Law and Public Safety (‘Division’) that the products do not contain intentionally added PFAS.
    • The certification is valid for five years.
    • A revised certification must be submitted for modification to the manufacturing or materials of the product.
    • The Division may provide rules or guidance for details on the certification and submission process.

These amendments are effective on August 27, 2028, two years after the bill was signed into law.
