New York 1,4-Dioxane Ban Comes into Effect Soon

Household cleansing, personal care, and cosmetic products sold or offered for sale in New York State will need to meet maximum allowable concentration levels of 1,4-Dioxane ban starting December 31, 2022.  The law includes provisions to allow a manufacturer to apply for a one-year waiver from compliance, up to two times, based on the submission of proof to the Department of Environmental Conservation (DEC) that they have taken steps to reduce the presence of 1,4-dioxane in their product or products and is still unable to comply with the statutory limits.  The Governor signed the bill on December 9, 2019. 

Definitions in the Act
“Cosmetic product” is any article intended to be rubbed, sprinkled, or sprayed on, introduced into, or otherwise applied to the human body or any part thereof for beautifying, promoting attractiveness or altering the appearance and intended for use as a component of any such article. It shall not include any personal care products. 

“Personal care product” is any product intended for cleaning or cleansing any part of the body, such as the skin and hair including but not limited to, hair shampoo, hair conditioner, soap, bath gels and other bath products. 

Summary
Manufacturers and retailers shall meet the below 1,4-dioxane limits for product sold by their respective dates. 

• Household cleaning products:
      o 2 ppm, by December 31, 2022
      o 1 ppm, by December 31, 2023 

• Personal care products:
      o 2 ppm, by December 31, 2022
      o 1 ppm, by December 31, 2023 

• Cosmetic products:
      o 10 ppm, by December 31, 2022
