OEHHA Listing of Bisphenol S (BPS) Under California Proposition 65

California’s Office of Environmental Health Hazard Assessment (OEHHA) has added Bisphenol S (BPS) to the list of chemicals known to the State of California as a reproductive toxicant within California Proposition 65.

Background: 
BPS is a bisphenol chemical which can be used to make synthetic textile fibers and to improve colorfastness in some fabrics. It can also be used to make hard plastic items. BPS can be sometimes used as a replacement for BPA.

It should be noted that several recent settlements for Bisphenol A (BPA) in textile products, such as socks and athletic shirts, include within the reformulation agreement that BPA cannot be replaced with any other bisphenol (such as Bisphenol S).

OEHHA Action: 
California’s OEHHA has determined that BPS is a reproductive toxicant (female reproductive endpoint). Therefore, OEHHA is adding Bisphenol S (BPS) to the list of chemicals within Proposition 65, effective December 29, 2023. The warning requirement for exposures to BPS will take effect on December 29, 2024, at which time 60 day notices could be issued.

Bureau Veritas will monitor the OEHHA website for 60 Day Notices pertaining to BPS, as notices can be issued after a chemical has been listed for one year.
