PFAS Updates and News: MN Amendment to Reporting Scope and TPCH Guide

Minnesota Amends PFAS Reporting
The reporting requirement under the Minnesota PFAS in products law has been amended.  Reporting now applies to products manufactured after July 1, 2023 that are sold, distributed or offered for sale as of January 1, 2026.

The reporting start date remains September 15, 2026, unless an extension has been granted by the Minnesota Pollution Control Agency (MPCA).  Request for extensions or waivers must be postmarked no later than August 16, 2026.

MPCA continues to put out more guidance and make enhancements to the reporting platform.  Information is publicly available on the page below.

TPCH Issues Strategy Guide for PFAS in Food Packaging
The Toxic in Packaging Clearinghouse (TPCH) has published a guide outlining strategies for ensuring compliance to PFAS in food packaging laws across the United States.  In the absence of defined limits and test methods in most states, the strategies include testing for total fluorine, total organic fluorine and/or specific PFAS, investigating test results with suppliers, and requesting certificates of compliance (CoC) or declarations from suppliers and manufacturers.


Each TPCH member state must adopt the model legislation into law in their state. States that have adopted laws to date have only included certain types of food packaging for PFAS restrictions.
