Proposed bill H.R. 6105, also cited as “No Toxics in Food Packaging Act of 2023,” would amend section 409 of the Federal Food, Drug, and Cosmetic Act to deem certain substances to be unsafe for use in food contact materials. The requirements would become effective two years after enactment of the Act.
Summary of the Bill
The following substances would be determined to be unsafe for use in food contact substances:
- Any chemical in the class of phthalates
- This means a class of chemicals that are esters of ortho-phthalic acid including DEHP, BBP, DBP, DIDP, DnHP, DINP, DNOP, DEP, DIBP, DPENP, DCHP
- Any chemical belonging to the class of PFAS
- Bisphenol A, B, S, F, AF or related compounds
- Styrene
- Antimony trioxide
