Washington State Amends Cookware Containing Lead Law

Washington Senate Bill 5975 – Safe Cookware amends existing law RCW 70A.565 Cookware Containing Lead regarding lead limits in aluminum and brass cookware, utensils, and cookware components.  

Summary of Updates

• As of January 1, 2026, aluminum or brass cookware, aluminum or brass utensils, and aluminum or brass cookware components may not be made, sold or distributed in the state of Washington, if it contains more than 90 ppm lead in product manufactured after January 1, 2026. 

• Beginning January 1, 2027, no manufacturer may manufacture, sell, offer for sale, distribute for sale, or distribute for use in the state of Washington aluminum or brass cookware, aluminum or brass utensils, or an aluminum or brass cookware component containing lead that has been intentionally added.
    o The bill defines intentionally added as meaning a chemical that serves an intended function in the final product or in the manufacturing of the product or part of the product.  It does not include chemicals present from the use of recycled materials.

• Beginning January 1, 2030, the lead limit will drop to 50 ppm, for products manufactured on or after January 2030.  

• Beginning January 1, 2034, the lead limit will further drop to 20 ppm for products manufactured on or after January 2034.  

• The bill also clarified that electrical components of electronic cooking devices and the non-food contact body of electronic cooking devices with removable cooking containers are not included within the scope. The internal cooking containers or pots for devices such as rice cookers and pressure cookers made of aluminum or brass are within the scope.
