Washington State Finalizes Cycle 1.5 PFAS Rule

Washington State Department of Ecology (‘Ecology’) has published amendments to the file rule for restrictions and reporting of certain product types including effective dates.  The rule becomes effective December 21, 2025.

Summary of Adopted Amendments
• Product Restrictions
    o On January 1, 2027, intentionally added PFAS will be restricted in:
        • Apparel and accessories.
        • Automotive washes.
        • Cleaning products – formulated products for residential, commercial or industrial use including cleaners for all-purpose, glass, bathroom, tiles, dishes and cleaners with disinfectants.
    o The prohibition exempts products manufactured before the 2027 date.

• Reporting
    o For the following products manufactured on or after January 1, 2026, information must be collected and reported by January 31, 2027:
        • Apparel intended for extreme and extended use (similar to apparel for wet weather conditions in other states).
        •Footwear.
        • Gear for recreation and travel made from leather or textiles including backpacks, bags, luggage, tents, foldable camp chairs, sleeping bags, climbing ropes, etc.
        • Automotive waxes.
        • Cookware and kitchen supplies.
        • Firefighting personal protective equipment (PPE).
        • Floor waxes and polishes.
        • Hard surface sealers.
        • Ski waxes.
    o The information required to be reported has not been updated and can be found in WAC 173-337-060. https://app.leg.wa.gov/WAC/default.aspx?cite=173-337

• The rule adds a 50 ppm Total Fluorine enforcement level, at which the department will assume PFAS has been intentionally included.  Manufacturers will have the opportunity to dispute this assumption with appropriate evidence.
