Washington State PFAS Priority Products Law

Washington State’s Governor signed a bill into law on March 31, 2022, which will accelerate the state’s ability to develop regulations for a variety of consumer goods that contain Perfluoroalkyl and polyfluoroalkyl substances (PFAS).

Summary
• HB 1694 requires the state of Washington’s Department of Ecology (DOE) to name PFAS-containing firefighting personal protective equipment a “priority product”.
• The bill also permits Washington’s DOE to name any product listed in the 2021 PFAS Chemical Action Plan as a “priority product”. This includes nonstick cookware, personal care products, cleaning agents, water-repellant clothing and gear, automotive products, and waxes and sealants for floors, skis, and cars.
• Also, HB 1694 allows the DOE to designate additional products as “priority products.” In the past, the DOE would add products to the “priority” list every five years. This bill accelerates the five year waiting period.
• The DOE will evaluate alternatives for PFAS in the listed products and develop related regulations by 2024. Final regulations are required by 2025.
