Governor Signs “Make Texas Healthy Again” Bill

On June 22, 2025, Governor Greg Abbott signed the “Make Texas Healthy Again” bill (SB 25) into law. Among other provisions, SB 25 requires a warning statement on human food if it contains one of the 44 substances specified in the law.

Specifically, if the FDA requires any of the 44 substances listed further below on the food label and ingredient list of a food intended for human consumption it will need to list the following statement:

"WARNING: This product contains an ingredient that is not recommended for human consumption by the appropriate authority in Australia, Canada, the European Union, or the United Kingdom”

The warning statement shall be in a font size no smaller than the smallest font used to disclose other consumer information required by the FDA, placed in a prominent and reasonably visible location, and in high contrast with the background. Additionally, if the product is sold online, then the above warning statement shall be disclosed on the manufacturer’s or retailer’s website where the product is offered for sale or otherwise communicated to the consumer.

The warning statement is required for products containing the following substances:

1.    Acetylated esters of mono- and 
diglycerides(acetic acid ester)
2.    Anisole
3.    Azodicarbonamide (ADA)
4.    Butylated hydroxyanisole (BHA)
5.    Butylated hydroxytoluene (BHT)
6.    Bleached flour
7.    Blue 1 (CAS 3844-45-9)
8.    Blue 2 (CAS 860-22-0)
9.    Bromated flour
10.    Calcium bromate
11.    Canthaxanthin
12.    Certified food colors by the United States 
Food and Drug Administration
13.    Citrus red 2 (CAS 6358-53-8)
14.    Diacetyl
15.    Diacetyl tartaric and fatty acid esters of 
mono-and diglycerides (DATEM)
16.    Dimethylamylamine (DMAA)
17.    Dioctyl sodium sulfosuccinate (DSS)
18.    Ficin
19.    Green 3 (CAS 2353-45-9)
20.    Interesterified palm oil
21.    Interesterified soybean oil

Applicability
Along other exceptions, the law does not apply to:

  • Food labeled, prepared, or served in a retail establishment or restaurant
  • Food regulated by the USDA FSIS
  • A product labeled with a governmental warning with a recommendation from the surgeon general of the United States Public Health Service
  • Drugs or dietary supplements

Preemption
SB25 includes a federal preemption clause (Sec. 431.0817), where the law would have no effect if one of the following occurs:

  • For a specific ingredient, including a food additive and color additive, the law or regulations:
    • Prohibit the use of the ingredient,
    • Imposes conditions on the use of the ingredient, including a condition requiring a warning or disclosure statement, or
    • Determines an ingredient or class of ingredients is safe for human consumption
  • The law or regulation requires a labeling statement relating to ultra-processed or processed foods

Effective Date
The law applies to food product labels developed or copyrighted on or after January 1, 2027.
