Effective July 1, 2028, cosmetic products sold in Illinois shall not contain any of the intentionally added ingredients identified in the Act.
Illinois HB3490, the Chemicals in Cosmetic Products Act, prohibits the following intentionally added ingredients:
- Dibutyl phthalate
- Diethylhexyl phthalate
- Formaldehyde
- Paraformaldehyde
- Methylene glycol
- Quaternium-15
- Mercury
- Isobutylparaben
- Isopropylparaben
- m-Phenylenediamine and its salts
- o-Phenylenediamine and its salts
- As well as the following per- and polyfluoroalkyl substances (PFAS) and their salts:
- Perfluorooctane sulfonate (PFOS) or heptadecafluorooctane-1-sulfonic acid
- Potassium perfluorooctanesulfonate or potassium heptadecafluorooctane-1-sulfonate
- Diethanolamine perfluorooctane sulfonate
- Ammonium perfluorooctane sulfonate or ammonium heptadecafluorooctanesulfonate
- Lithium perfluorooctane sulfonate or lithium heptadecafluorooctanesulfonate
- Perfluorooctanoic acid (PFOA)
- Ammonium pentadecafluorooctanoate
- Nonadecafluorodecanoic acid
- Ammonium nonadecafluorodecanoate
- Sodium nonadecafluorodecanoate
- Perfluorononanoic acid (PFNA)
- Sodium heptadecafluorononanoate
- Ammonium perfluorononanoate
The law includes an exception for certain scenarios where the product contains a technically unavoidable trace quantity of a substance.
Note: These ingredients are already prohibited by other state cosmetic ingredient bans.
