Proposition 65 – OEHHA Issues Informational Letter Regarding Testing for Vinyl Acetate

California’s Office of Environmental Health Hazard Assessment (OEHHA) has issued an informational letter regarding: Exposures to Vinyl Acetate from Consumer Products.

Summary:  
As reported in May 2025, OEHHA added vinyl acetate to the Proposition 65 chemical list as a carcinogen. The warning requirement for exposure to vinyl acetate will take effect on January 3, 2026.  Note that vinyl acetate is used in the production of polymers and copolymers, for example, polyvinyl acetate (PVA) and ethylene-vinyl acetate (EVA) copolymers, as well as other materials.

Recently, OEHHA posted a guidance letter regarding vinyl acetate.  In that letter, OEHHA advised that when a party issues a 60-day Notice, the party must include factual information in order to establish the basis of Notice. OEHHA further advised that the test for this chemical should determine the amount of vinyl acetate released from the product during use/exposure.  Tests which determine the vinyl acetate present in the product would also be useful.  However, the test should not represent the amount of vinyl acetate obtained from dissolving vinyl acetate-containing polymers in a manner which would not normally occur during the use, purchase, storage, maintenance, or repair of the product.
