Sweden Proposes National Restriction of PFAS

Sweden’s Ministry of Climate and Enterprise issued a memorandum to propose a national restriction of per- and polyfluoroalkyl substances (PFAS).

Background
Even though the EU is working on a general restriction on per- and polyfluoroalkyl substances (PFAS), Sweden doesn’t expect a binding legislation within one or two years. Therefore, the Sweden’s Ministry of Climate and Enterprise issued a memorandum to propose a national restriction of PFAS, following initiatives in France and Denmark.

PFAS definition follows the definition in the PPWR (EU 2025/40). The scope of the proposal covers:

  • clothing and footwear
  • impregnating agents for clothing and footwear
  • cosmetics
  • food contact kitchen utensils and 
  • ski waxes.

Exemptions should be granted for clothing containing at least 20% recycled materials, personal protective equipment (PPE), impregnating agents for re-impregnation of PPE, and products that have been in use and are suitable for continued use, including those that have been repaired.

Proposed limits are as follows:
< 25 µg/kg for individual non-polymeric PFAS
< 250 µg/kg for the sum of non-polymeric PFAS, including those from degradation of precursors
< 50 mg/kg (ppm) Total Fluorine (for the sum of all PFAS)

This restriction is proposed to come into force on 1 January 2028 but would only apply if no equivalent prohibition in EU REACH or POP regulation is available, and it would be repealed once equivalent EU legislation enters into force.
