On January 16, 2025, the U.S. Food and Drug Administration (FDA) proposed front-of-pack nutrition labeling requirements for most food products that require Nutrition Facts labeling. The proposed rule will require a Nutrition Info box on the front panel of the package that provides information about the amount of Saturated Fat, Sodium, and Added Sugars per serving of the product.
The Nutrition Info box will normally consist of:
- The heading “Nutrition Info”
- Per serving” information
- “% Daily Value” heading
- The % DV of Saturated Fat, Sodium, and Added Sugars per serving
- The terms “Low”, “Med”, “High” based on the percent Daily Value (DV) for Saturated Fat, Sodium, and Added Sugars where:
- Low: 5% or less of the DV
- Med: 6-19% of the DV
- High: 20% or more of the DV
- “FDA.gov” banner at the bottom of the box
No additional information is allowed in the Nutrition Info box. For example, Calories are not required and therefore, shall not be listed in the Nutrition Info box, but calorie information may voluntarily be included elsewhere on the front of the food package.
The Nutrition Info box must be on the upper third of the principal display panel (PDP). It shall meet the type size and formatting requirements specified in the proposed rule including the following:
- The “Nutrition Info” heading shall be in a larger type than all other words in the box
- The other information shall be in a minimum type size that is no smaller than the required net quantity statement size (at least 8 point)
- The text and hairlines shall be all black or one color type
- The box shall have a white or other neutral background
- Saturated Fat, Sodium, and Added Sugars shall be listed in bold text
- “% Daily Value”, and Low / Med / High shall be listed in extra bold text
The proposed rule provides clarification and example labels for
- Intermediate-sized food packages – Those with forty (40) or fewer square inches available to bear labeling
- Products labeled as “as packaged” or “as prepared”
- Aggregate packaging
There are exemptions for certain products such as:
- Foods exempt from nutrition labeling under 21 CFR 101.9
- Foods in small packages that have a total surface area less than 12 square inches
- Packages marketed as gifts with a variety or assortment of foods
- The unit containers in a multiunit retail package where: The unit contains are exempt from
- Nutrition Facts labeling per 21 CFR 101.9(j)(15) and the multiunit retail food package has the Nutrition Info box(s).
Additionally, to ensure alignment with nutrient content claims and the Nutrition Info box, the FDA is proposing updates to the CFRs on nutrient content claims for Sodium and Saturated Fat.
If passed, the proposed rule has a three year compliance date for business with $10 million or more in annual food sales and a four year compliance date for business with less than $10 million in annual food sales.
