Australia Issues Updates to the Mandatory Safety Standard of Aquatic Toys

Australian Competition and Consumer Commission (ACCC) has issued an update to the mandatory safety standard of aquatic toys - Consumer Goods (Aquatic Toys) Safety Standard 2020. There is a transition period of 24 months beginning on the day of commencement of the updated standard (June 12, 2020).   

According to the updated standard: 

“aquatic toy” means a toy that is designed:
-    to bear the mass of a child under the age of 14; and
-   for use in play in shallow water by a child;
whether or not it is inflatable and whether or not it is designed to be worn or otherwise attached to the body.

An aquatic toy shall comply with one of the following requirements:
-    AS/NZS ISO 8124.1:2019 clause 4.20 Aquatic toys; or
-    ISO 8124-1:2018 clause 4.20 Aquatic toys

In addition, an aquatic toy shall carry the aquatic toy warning as required by the standard and the warning must be:     
-    in English; and
-    clearly legible; and
-    clearly visible; and
-    indelible. 

There is a transition period of 24 months beginning on the day of commencement of the updated standard (June 12.2020). During the transitional period, an aquatic toy must comply with either:
-    the updated standard “Consumer Goods (Aquatic Toys) Safety Standard 2020”; or 
-    the previous standard “Consumer Protection Notice No. 2 of 2009 (Consumer Product Safety Standard for Flotation Toys and Aquatic Toys”. 

After the transitional period, an aquatic toy must comply with the updated standard.
