Canada Published Regulations Amending Certain Regulations Made Under the CCPSA

The Regulations (SOR/2022-122) amend the Surface Coatings Materials Regulations and four other regulations under the Canada Consumer Products Safety Act (CCPSA) that set out requirements for applied coating materials. The amended Regulations will come into force on December 19, 2022, which is 180 days after published in the Canada Gazette, Part II

Summary
The objective of the Regulations is to amend the surface coating materials and applied coating materials requirements under CCPSA to be clear, consistent, include all types of coating materials including stickers or similar materials, and better align with the U.S., without imposing unnecessary compliance and testing burden on the industry. 

The following five regulations will have the below revisions:
• Toy Regulations
• Cribs, Cradles and Bassinets Regulations
• Expansion Gates and Expandable Enclosures Regulations
• Surface Coatings Materials Regulations
• Playpens Regulations 

Revisions include:
• Adds sticker, film and other similar materials that can be removed to the heavy metals surface coating testing scope
• Limits heavy metal compliance to only accessible parts
• Removes the 5% hydrochloric acid,10 minutes stirring at 20°C (68°F) method and allows testing to commonly used methods for products destined for the US, EU or other jurisdictions, such as ASTM F963, EN 71:3.
• Defines a 10 mg/kg limit for mercury in sticker, film and surface coating materials, which aligns with the Surface Coating Materials Regulations
• Changes the migration limit of 0.1% to the equivalent of 1000 mg/kg to align with the lead and mercury units of measure. 

Additionally, under the Surface Coatings Materials Regulations, the 90 mg/kg lead regulation for products with applied surface coating materials will expand to include coatings on all furniture, not just children’s furniture.  This will improve alignment with the U.S. as the U.S. regulates lead in coatings on all furniture.
