The Connecticut Governor signed new PFAS in products into law on June 5, 2024. This law includes requirements for reporting, labeling and bans on intentionally added PFAS.
Requirement Summary and Effective Dates:
Reporting and Labeling
• As of July 1, 2026, apparel, carpet or rug, cleaning product, cookware, cosmetic product, dental floss, fabric treatment, children's product, menstruation product, textile furnishings, ski wax, or upholstered furniture cannot be sold, offered or distributed for sale in Connecticut with intentionally added PFAS in/on them unless they are reported to the state and labeled as containing PFAS. Where possible, reporting can be done as a category instead of by individual products. Information to be reported includes:
o Brief description of the product including product category;
o Purpose and/or function of the PFAS in the product;
o Each PFAS listed by its chemical abstracts service registry (CAS) number or, in the absence of this number, the molecular formula and weights of all PFAS intentionally added,
o For a product category, the amount of each PFAS or subgroups, as an exact quantity or as a range of PFAS, reported as percent weight.
o If no available analytical methods, the amount of total fluorine in each product category.
o Name and address of the manufacturer, and the name, address and phone number of a contact person for the manufacturer; and
• Any product listed above that contains a PFAS containing component must be labeled.
• Labels must be legible and visible at point of sale using approved language to convey that PFAS is present, as well as made of durable enough to remain legible for the useful life of the product.
• Labels should be affixed to product or packaging by the manufacturer unless the wholesaler or retailer has agreed to assume the responsibility.
Labeling
• As of January 1, 2026, outdoor apparel for severe wet conditions cannot contain intentionally added PFAS and be sold, offered or distributed for sale in the state of Connecticut unless they are labeled as “Made with PFAS chemicals.”
Ban
• As of January 1, 2028, all products listed above would be prohibited from containing intentionally added PFAS and the labeling allowance would be repealed.
