CPSC Publishes Notice of Proposed Rulemaking within Federal Register for Infant and Infant/Toddler Rockers

On October 26, 2023, the U.S. Consumer Product Safety Commission (CPSC) staff published within the Federal Register a Notice of Proposed Rulemakings for a Safety Standard for Infant and Infant/Toddler Rockers (16 CFR 1240).
Section 104 of the Consumer Product Safety Improvement Act of 2008 (CPSIA), requires the United States Consumer Product Safety Commission (Commission or CPSC) to promulgate consumer product safety standards for durable infant or toddler products. These standards are to be ‘‘substantially the same as’’ applicable voluntary standards or more stringent than the voluntary standard if the Commission concludes that more stringent requirements would further reduce the risk of injury associated with the product. The Commission is proposing a safety standard for Infant and Infant/Toddler Rockers in response to the direction under Section 104(b) of the CPSIA.
An Infant Rocker is defined as a freestanding product intended to support an occupant who has not developed the ability to sit up unassisted, up to 20 lb. (approximately 0 through 6 months of age), in a seated, reclined position greater than 10° and to facilitate rocking by the occupant with the aid of the caregiver or by other means.
An Infant/Toddler Rocker is defined as a freestanding product intended to support an occupant in a seated, reclined position greater than 10° and to facilitate rocking by the occupant with the aid of the caregiver or by other means until the occupant is approximately age 2.5 years, up to 40 lb.
The CPSC staff recommends adopting the requirements specified in ASTM F3084-22, Standard Consumer Safety Specification for Infant and Infant/Toddler Rockers, as mandatory with eighteen modifications specific to revised definitions, new definitions, modifications to the stability test, inclusion of a tethered strap, drop test, battery compartment, firmness, and concavity evaluation, and revisions to product warnings.
The Commission also intends to amend the consumer registration rule, 16 CFR 1130, to identify Infant and Infant/Toddler Rockers as durable infant or toddler products thus requiring consumer registration cards for Infant and Infant/Toddler Rockers.
Once a Final Rule is approved and published in the Federal Register, the tentative effective date will be 180 days from the date of publication within the Federal Register.
Public comments on the Infant and Infant/Toddler Rocker NPR may be submitted up to December 26, 2023.
