France Releases Updated PFAS Regulation for Consumer Products

On 30 December 2025 France published Decree No. 2025–1376 of 28 December 2025 on the Prevention of Risks Resulting from Exposure to Perfluoroalkyl and Polyfluoroalkyl Substances.

France enacted Law No. 2025-188 (1) on February 27, 2025, prohibiting the use of PFAS in cosmetics, textiles, and ski waxes, with the ban coming into effect in January 2026. Additional restrictions will be extended to all PFAS-containing textiles by 2030.

To enforce this legislation, France recently issued Decree No. 2025-1376 dated December 28, 2025, concerning the prevention of risks associated with PFAS exposure. The decree was officially published in The Official Journal 'Laws and Decrees' (JORF) No. 0305 on December 30, 2025, marking its formal adoption and nationwide legal implementation. Effective January 1, 2026, the decree establishes stringent regulations on PFAS, commonly known as 'forever chemicals.' Products manufactured prior to this date are provided with a 12-month grace period for inventory clearance.

The regulation restricts the production, import, and sale of PFAS-containing products when safer alternatives are available. It covers cosmetics, ski waxes, clothing, footwear, and waterproofing agents. The Decree defines the following limits:

  1. For any PFAS measured by a targeted analysis, excluding polymers, the threshold is set at 25 ppb.
  2. For the sum of PFAS measured as the sum of targeted PFAS analysis, where applicable with prior degradation of precursors, excluding polymers, the threshold is set at 250 ppb.
  3. For PFAS including polymers, the threshold is set at 50 ppm. In the event that the total fluorine measurement exceeds 50 mg F/kg, the manufacturer, importer, exporter, or person placing on the market shall provide, at the request of the competent authorities, proof that the fluorine content originates from PFAS or non-PFAS substances.

These values are subject to revision in the event of changes to the technical arrangements established under European Regulations (EC) 1907/2006 or (EU) 2019/1021.

Certain exemptions are permitted for clothing textile and footwear products:

  1. Personal protective equipment (PPE) under EU Regulation 2016/425, including PPE and combat equipment for the armed forces, internal security and civil protection services
  2. Waterproofing products utilized for re-waterproofing the afore mentioned PPE.
  3. Clothing, textiles, and footwear containing a minimum of 20% post-consumer recycled materials, with PFAS levels restricted to residual amounts derived from the recycled content and proportional to its usage.
