Health Canada Issues Proposal for Revised Tents Regulation within the Canada Gazette Part I

In an effort to further strengthen Canadian safety requirements for tents, Health Canada has issued proposed revisions to the Tents Regulations (SOR/2016-185). The proposed revisions will also result in revisions to the Toys Regulations (SOR/2011-17) and the Textile Flammability Regulations (SOR/2016-194). The proposed revisions were published into the Canada Gazette Part I, Notices and Proposed Regulations, Volume 157, Number 24 (2023) on June 17, 2023.

Background Summary
The Tents Regulations became effective January 21, 1988 and include labeling requirements and flammability requirements for the floor, wall and top materials of tents. The Tents Regulations was transferred to the Canadian Consumer Products Safety Act (CCPSA) in 2011. Non-substantive changes have been made to the Tents Regulations since its inception. The Tents Regulations currently references certain sections of the CPAI-84 (1995) standard.

Summary of Revised Regulation
The proposed Tents Regulations include the following changes;

  • Health Canada is proposing to replace the current flammability and fire-safety labelling requirements in the Tents Regulations with the updated requirements developed by the Canadian General Standards Board in their standard entitled CAN/CGSB-182.1-2020 Flammability and Labelling Requirements for Tents.
  • Health Canada is also proposing to add flammability performance and fire-safety labelling requirements to the Toys Regulations, with reference to ISO 8124-2, Safety of Toys, in order to continue regulating children’s play tents not intended to be used as outdoor shelters because Health Canada proposes to exclude them from the Tents Regulations.
  • Health Canada is proposing to amend the Textile Flammability Regulations to exclude children’s play tents from those regulations as they will be regulated under the Toys Regulations.

This proposal is intended to improve the safety of tents and children’s play tents distributed into Canada. If approved, there will be a flexible transition period offered for tents distributed into Canada to reduce the regulatory burden impact to businesses.

Interested parties have until August 26, 2023 to provide comments on the proposed revisions.
