Health Canada Publishes Revised Tents Regulation within the Canada Gazette

Nov. 27 2024

On November 20, 2024, the Canadian government published within the Canada Gazette revised requirements for Tents. The revised regulation is designated as SOR/2024-217 and became effective upon publication within the Canadian Gazette.

Background Summary
The Tents Regulations became effective January 21, 1988 and included labeling requirements and flammability requirements for the floor, wall and top materials of tents. The Tents Regulations was transferred to the Canadian Consumer Products Safety Act (CCPSA) in 2011. Non-substantive changes have been made to the Tents Regulations since its inception. The Tents Regulations currently references certain sections of the CPAI-84 (1995) standard. These latest proposed revisions were published in Canada Gazette on June 17, 2023.

The Tent regulation has been revised and published within the Canada Gazette. The new regulation includes a reference to CAN/CGSB-182.1-2020, Flammability and Labeling Requirements for Tents along with other revisions.

Summary of Revised Regulation
The revised Tents Regulations include the following changes;

  • The revised tent regulation includes new definitions for (1) components and accessories, (2) safety standard, and (3) tent. The revised tent regulation also includes specification changes for (1) performance and testing requirements, (2) flooring materials, (3) labeling requirements, (4) children’s tent, (5) appliance clarification, and (6) a compliance period explanation for the revised regulation.
  • Health Canada is also revising the toy regulation by adding a flammability and labeling section to the toy regulation specific for toys intended to be entered by a child with reference to ISO 8124-2.
  • Health Canada is also revising the Textile Flammability Regulations to exclude toys intended to be entered by a child as they will be now regulated under the Toys Regulations.

This regulation is effective as of the publication date within the Canada Gazette. However, a transitional provision was added. Product compliant to the previous regulations can continue to be manufactured, imported, advertised and sold for two years.
