Illinois Expands Products in Future PFAS Prohibition

Illinois HB 2516, now known as Public Act 104-0231, has amended the Illinois PFAS ban that originally included firefighting apparel and gear.  This amendment adds more categories to prohibit intentionally added PFAS as of January 1, 2032.

In addition to the added products, the Illinois EPA has been tasked with reporting on fluoropolymer data and regulatory activity by August 2027.

Effective January 1, 2032, the Illinois law adds the following products to the ban on intentionally added PFAS:
• cosmetics;
• dental floss;
• juvenile products;
• menstrual products, disposable and reusable; and
• intimate apparel.
         o Intimate apparel refers to garments worn under clothing and typically has direct skin contact including bras, boxers, briefs, shapewear, sleepwear, thermals, loungewear, socks, and stockings.

Packaging is not included in the prohibition related to these products and intentionally added does not include if the PFAS comes from the water used to make the products if the manufacturer did not alter the water to add PFAS.

Additionally, by August 2027, the Illinois EPA must submit a report to the General Assembly related to assessing fluoropolymers including a plan for collecting research and data on legislative and regulatory activity, scientific research, critical uses and impact to the supply chain, as well as funding needed to perform the study.
