Louisiana Passes SB 14: Disclosure of Harmful Ingredients in Food Law

On the heels of the “Make Texas Healthy Again” bill, Louisiana passed their own food labeling law for products containing any of the 44 substances identified in the law. Notably, the 44 substances identified in the Louisiana law are slightly different from that identified in the Texas law. 

Louisiana will require a QR code and labeling on human food products sold in Louisiana containing the following substances:

1.    Acesulfame potassium        23.    Lye
2.    Acetylated esters of mono- and diglycerides (acetic acid ester)    24.    Morpholine
3.    Anisole    25.    Olestra
4.    Aspartame26.    Partially hydrogenated oil (PHO)
5.    Azodicarbonamide (ADA)    27.    Potassium aluminum sulfate
6.    Butylated hydroxyanisole (BHA)    28.    Potassium bromate
7.    Butylated hydroxytoluene (BHT)    29.    Potassium iodate
8.    Bleached flour    30.    Propylene oxide
9.    Blue dye 1 (CAS 3844-45-9)31.    Propylparaben
10.    Blue dye 2 (CAS 860-22-0)    32.    Red dye 3 (CAS 16423-68-0)
11.    Bromated flour    33.    Red dye 4 (CAS 4548-53-2)
12.    Calcium bromate    34.    Red dye 40 (CAS 25956-17-6)
13.    Canthaxanthin35.    Sodium aluminum sulfate
14.    Certified food colors by the United States Food and Drug Administration 36.    Sodium lauryl sulfate

Labeling Requirements 
Food for human consumption with any of the above substances shall include a QR code with a statement that additional ingredient information can be accessed by scanning the code. The QR code shall link to a website “under the control of the manufacturer” with the following disclaimer in a prominent location “NOTICE: This product contains [insert ingredient here]. For more information about this ingredient, including FDA approvals, click HERE.” The disclaimer shall link to the FDA website regarding food chemical safety. If the product is a multiunit package, the labeling requirements only apply to the outer container. 

Applicability
The law does not apply to:
• Drugs or dietary supplements
• Alcoholic beverages
• Food prepared and labeled in a retail food establishment
• Medical foods

Additional Provisions
The law also prohibits 15 food additives and colorants in school food and requires the disclaimer “Some menu items may contain or be prepared using seed oils” if a food service establishment cooks or prepares food with seed oils. 

Effective Date
The Act will take effect on January 1, 2028.
