Postponed PFAS Reporting
Minnesota’s requirement for report products containing intentionally added PFAS was scheduled to become effective January 1, 2026. Reporting will now be required for product on the shelf on or after July 1, 2026.
The Minnesota Pollution Control Agency (MPCA) has been working on a final rule outlining enforcement rules and points of clarification around the law and has taken comments through late May 2025. Based on comments received, they have agreed to postpone the start date for reporting.
This extension was given to provide manufacturers with more time to:
• Work with suppliers to gather information for reporting;
• Become familiar with the reporting database, set to be released in Fall 2025.

Exemptions Added to PFAS Prohibition
Based on industry comments received and recommendations from the MPCA, PFAS legislation related to prohibiting certain products that contain intentionally added PFAS has been amended. The amendments add specific exemptions as follows:
• Under the definition of juvenile products, not included are child versions of off-highway vehicles, all-terrain vehicle, off-highway motorcycles, snowmobiles, electric-assisted bicycle and replacement parts for these vehicles.
• For any covered product, the prohibition does not include electronic components or internal components that contain intentionally added PFAS
o Internal components are defined as “internal parts of a product, whether permanently affixed or removable, that are designed and intended to not be touched by a person during intended use or handling. Internal components include parts of a product used for holding batteries regardless of whether the parts are touched when replacing batteries.”
