Netherlands Revises Food Contact Ceramic Requirements

The Dutch Ministry of Health, Welfare, and Sport has amended the Commodities Act Regulation on Packaging and Consumer Products to include strengthened migration limits for lead and cadmium as well as requirements to comply with EU Directive 84/500/EEC with appropriate declarations and documentation.

Requirement Summary and Effective Dates:

On May 4th, 2026, the Netherlands’ Ministry of Health, Welfare, and Sport published an amendment to the requirements for food contact ceramic products under the Dutch Commodities Act Regulation on Packaging and Consumer Products. The law came into effect on May 29th, 2026. Articles first placed on the market before December 1st, 2026 that comply with the regulation as it was written on or before 28th May, 2026 may remain on market until existing inventory is exhausted.

The new leachable lead and cadmium limits in Food Contact Ceramic Products in this amendment are as listed below:

Category I:
Articles which cannot be filled and articles which can be filled, the internal depth of which, measured from the lowest point to the horizontal plane passing through the upper rim, does not exceed 25 mm

≤ 6 µg/dm²

≤ 4 µg/dm²

Category II:
All other articles which can be filled

≤ 30 µg/L

≤ 20 µg/L

Category III:
Cooking ware; packaging and storage vessels having a capacity of more than three liters

≤ 10 µg/L

≤ 7 µg/L
 

Notes:

1. If a ceramic article consists of a vessel with a ceramic lid, the specific migration limits above apply to the vessel only.

2. If a ceramic article does not exceed the specific migration limits above by more than 50%, that object shall be deemed to be compliant if at least three other articles with the same shape, dimensions, decoration and glaze are subjected to a test carried out under the conditions referred to in Annexes I and II of Directive 84/500/EC and:

    • the average quantities of lead and/or cadmium extracted from the articles do not exceed the established limits.

    • each article individually does not exceed these limits by more than 50%.

Then amendment also states that product documentation is expected to show compliance to these new migration limits.
