New Mexico Signs PFAS in Products Law

New Mexico has become the most recent US state to enact a law banning intentionally added PFAS in specific product types.  HB0212, or the “Per- & Poly-fluorinated Protection Act,” provides timelines for specific products to comply with the law.

  • Effective Dates for banning intentionally added PFAS for listed products sold, distributed or marketed for sale:
    • Starting January 1, 2027: cookware; food packaging; dental floss; juvenile products; and firefighting foam.
    • Starting January 1, 2028: carpets or rugs; cleaning products; cosmetics; fabric treatments; feminine hygiene products; textiles; textile furnishings; ski wax; and upholstered furniture.
    • Starting January 1, 2032: any product that has not been determined to have an unavoidable use for the PFAS.
  • Additional products can be added to these bans.  However, there has to be at least six months before the effective date and the date must not be before January 1, 2027.
    • Exemptions exist for products that cannot be added to the bans.  See link below for details.
    • A rule will be adopted to outline required information and processes if a waiver or extension is requested by the manufacturer.
