Oregon Amends Toxic-Free Kids Act

The passage of Oregon’s House Bill 3043 provides several amendments to the state’s Toxic-Free Kids Act.  Manufacturers that sell children’s products in Oregon are required to report products that contain high priority chemicals of concern for children’s health (HPCCCH).  The amendments became effective January 1, 2025.

Highlights

  • The below ten chemicals have been added to the list.  The list now contains a total of 83 chemicals.  The chemicals are aligned with those of the Washington State Children’s Safe Product Act list. 
    • Di-(2-methoxyethyl) phthalate (DMEP) (117-82-8)
    • Tris (2,3-dibromopropyl) phosphate (TDBPP) (126-72-7)
    • Tri-n-butyl phosphate (126-73-8) (TNBP)
    • Dipentyl phthalate (131-18-0) (DPP)
    • Perfluorooctanoic acid and related substances (PFOA) (335-67-1)
    • Tricresyl phosphate (TCP) (1330-78-5)
    • Bis (2-ethylhexyl) tetrabromophthalate (TBPH) (26040-51-7)
    • Bis(chloromethyl)propane-1,3-diyl tetrakis-(2-chloroethyl) bis(phosphate) (V6) (38051-10-4) 
    • Isopropylated triphenyl phosphate (IPTPP) (68937-41-7)
    • Decabromodiphenyl ethane (DBDPE) (84852-53-9)
  • Reporting must include both the brand name and product model to specify the children’s product.  Also, the reporting must include the chemical concentration ranges for each component that includes the reportable chemical level in the children’s product.
  • The reporting deadline is moved from January 1 to January 31 of the even-numbered years. The next reporting cycle due is January 31, 2026 for products sold in 2024 and 2025.
  • Hazard assessments (HA) for chemical substitutions must be resubmitted every three years, yet manufacturers may now be exempt from submitting a third HA if the substitute chemical has been approved for six years.   Products sold with substitute chemicals must be covered by an approved HA.
  • Manufacturers are allowed to add chemically identical product models to an approved exemption list.
