Pennsylvania Proposes Heavy Metals in Baby Food Bill

Draft bill HB 2535 “Baby Food Protection Act” establishes heavy metal limits and labeling requirements for baby food sold or distributed in the state of Pennsylvania.  The bill defines baby food as food that is pureed or minced to be easily consumed by babies or toddlers under two years of age.  If approved, it becomes effective one year after enactment. 

The bill requires the following:
• The Department of Health of Commonwealth must test a representative sample of each batch of baby food manufactured in the state for the presence of inorganic arsenic, lead, cadmium mercury or other toxic heavy metals.
• Baby food must meet the following limits:
      o 10 ppb inorganic arsenic
      o 5 ppb lead
      o 5 ppb cadmium
      o 2 ppb mercury
• If at any time the FDA sets lower limits or regulates other metals, the department shall adopt the lower federal requirements.
• All baby food that has been tested by the department under this act must be affixed with a label noting the levels of inorganic arsenic, lead, cadmium and mercury found in the representative sample from that batch and the presence of other toxic heavy metals.
