The United States has taken recent actions at the Federal level regarding PFAS reporting and possible PFAS in products restrictions. The US EPA has postponed the reporting start date under TSCA 8(a)(7) and the US Senate has introduced a proposed bill addressing prohibitions of PFAS use in products.
Delay of Reporting Start Date
The US EPA has issued a modification to the timeline for starting to report items containing PFAS under TSCA 8(a)(7). This delay gives the agency more time to review comments provided on the draft final rule including the potential exemption for imported items containing PFAS.
The new start date is set as either 60 days after the final rule is published or January 31, 2027, whichever is earlier.
House and Senate Proposed PFAS Bills
Both the US Senate and House of Representatives have proposed identical bills to restrict PFAS in products, SB 4153/ HR8016, “Forever Chemical Regulation and Accountability Act of 2026.” If enacted, the bill would outline a plan to prohibit PFAS in consumer products and for all non-essential uses. Within the first 1-2 years after enactment, products such as carpets and rugs, juvenile products, food packaging, apparel, cosmetics and indoor furniture would be restricted for intentional use of PFAS. In addition, manufacturer reporting requirements would be enacted including submission of a 10-year phase out plan by each manufacturer within 3 years of the bill being enacted.
