Vermont S.25 was signed into law on May 30, 2024. This marks the twelfth U.S. state to enact legislation banning intentionally added PFAS in specific product types or food packaging.
Requirement Summary and Effective Dates
• Cosmetics and menstrual products prohibited from containing PFAS and other listed chemicals such as phthalates and 1,4-Dioxane. Effective as of January 1, 2026 with additional amendments in places as of January 1, 2027.
• Incontinence products, aftermarket fabric treatments, carpets and rugs, artificial turf, cookware, ski wax, juvenile products, effective January 1, 2026, prohibited to have intentionally added PFAS in any amount.
• Textile articles including apparel and accessories, footwear, bags, home textiles, upholstery, effective January 1, 2026 cannot have intentionally added ‘regulated’ PFAS, defined as:
o PFAS knowingly added for a functional or technical purpose or a chemical that intentionally breaks down into a PFAS; or
o Presence of Total Organic Fluorine at or above 100 ppm (to drop to 50 ppm for apparel and textile articles in 2027).
• Outdoor apparel for severe wet conditions will need to comply with the apparel requirements as of January 1, 2028.
• Firefighting products including foam and personal protective equipment are also included in the bill. See the laws for details.
• Current requirements that were enacted previously for firefighting products, carpets and rugs, aftermarket fabric treatments, food packaging and ski wax will be repealed as of January 1, 2026.
